Terms and Conditions of Sale / Contract

Tampa Terrazzo By Al Services Of Tampa Bay LLC (aka Tampa Terrazzo)

Payment and Credit Terms

No jobs will be scheduled until a 51% deposit is paid. By making the deposit, the Customer verifies acceptance of the project proposal/estimate as presented.

All invoices must be paid in full upon completion unless other credit arrangements have been made. If the Customer's account has a past due balance, the Customer will be classified as prepayment only. Tampa Terrazzo accepts MasterCard, Visa, Discover, and Zelle.

Final Payment

All final invoices and payments must be completed on the last day of the job/project and within 24 hours. If the balance is not paid upon completion, an additional 3% per month will be added until paid in full, starting from the day the job is completed.

Check Policy

All checks must be made payable to Tampa Terrazzo By Al Services Of Tampa Bay LLC. A $25.00 fee will be charged for any returned check.

Late Payment Fee

Tampa Terrazzo charges 3% per month (36% per year) starting upon completion of the job. Collection fees of 25% also apply.

Right to Stop Work

If payments are not made when due and in a timely fashion, Tampa Terrazzo has the right to stop work. The Customer will be charged an additional 10% on late draw payments. If work is stopped by the Customer, Tampa Terrazzo has the right to cancel the contract and renegotiate a new one. The Customer will owe payment for all work completed and all materials ordered, plus 10% added to the contract price. The Customer is responsible for protecting all materials on the job site.

Attorney Fees and Collection Costs

If the Customer defaults on payment, the Customer agrees to pay all collection costs and reasonable attorney's fees.

Cancellation Clause

Tampa Terrazzo reserves the right to cancel this contract in the event of any unusual circumstance.

To cancel as the Customer, the Customer must provide written notice to Tampa Terrazzo within 72 hours after approving the estimate online. Upon timely cancellation, the Customer will receive a refund of 80%, less the cost of any materials already ordered for the project and/or any work completed, including any commissions and related charges.

If cancellation notice is not provided within 72 hours, the Customer's deposit will be non-refundable.

All work scope details and pricing are provided on the front page of the agreement.

Special Orders & Supplies/Materials

Special order materials and all supplies/materials require a prepaid deposit. No returns or refunds. All prepaid deposits are nonrefundable.

Color and Shade Matching

Tampa Terrazzo is very good at what Tampa Terrazzo does. However, Tampa Terrazzo cannot guarantee an exact color or shade match for many products, including fired clay, natural stone, grout, epoxy, or terrazzo repairs. Tampa Terrazzo promises to do its best to achieve the closest possible match.

Stain Removal

Many stains can be lightened or removed, but Tampa Terrazzo does not guarantee complete stain removal. Additional charges may apply. No one has the authority to change this policy or to infer otherwise.

Water Use and Protection

Water may seep under walls, cabinets, or doors during the process. Tampa Terrazzo uses protective tape and plastic, but Tampa Terrazzo is not responsible for any water damage that occurs.

Dust

Dust is a normal part of grinding and polishing. Tampa Terrazzo is not responsible for protecting the Customer's belongings from dust, unless the Customer has specified exact protection to be priced separately (time and material). It's always best to use a portable on-demand storage unit for full restoration work.

Environment / Working Conditions

The Customer should keep the air conditioner running during the job to help remove moisture and heat. The Customer should replace the return air filter before Tampa Terrazzo starts with a fine particle filter and again after Tampa Terrazzo finishes.

Cleanup

Tampa Terrazzo will leave the work area in a clean and broom-swept condition upon completion of the project.

Moving Furniture

Tampa Terrazzo charges $82 per man-hour or $164 per room for moving furniture or other items. This covers insurance and workers' compensation.

Electrical Needs

The Customer agrees to provide 220/110 a/c electrical power.

Waste Disposal and Debris Removal

The Client is responsible for providing, at their sole expense, appropriate disposal receptacles (such as dumpsters, roll-off containers, or suitable waste bins) of sufficient size and capacity for all jobsite waste generated during the Work. This includes, but is not limited to, construction debris, removed materials, packaging, grinding dust, concrete/paver residue, and wet slurry produced from grinding, honing, polishing, or cutting operations.

Slurry-Specific Requirements: The Client acknowledges that terrazzo, stone, and concrete restoration work generates significant volumes of wet slurry (a mixture of water, fine particles, and sediment). The Client must provide suitable containment and disposal methods compliant with local regulations to prevent slurry from entering storm drains, sewers, waterways, or neighboring properties. The Contractor will direct slurry into approved on-site containment during operations, but the Client is fully responsible for its final lawful removal and disposal.

The Client shall either: • Arrange and pay for the delivery, maintenance, pickup, and proper disposal of all waste receptacles and slurry through their own licensed waste management provider, or • Reimburse the Contractor for all costs associated with delivery, rental, hauling, and disposal of any receptacles and slurry handling services provided by the Contractor.

The Contractor shall not be responsible for providing or paying for waste or slurry disposal services unless explicitly agreed upon in writing as an additional service with separate charges.

All waste and slurry must be handled and disposed of in full compliance with all applicable federal, state, and local environmental laws and regulations. Failure to provide adequate containment may result in project delays, for which the Client will be responsible. The Client agrees to indemnify, defend, and hold harmless the Contractor, its owners, employees, and subcontractors from any fines, penalties, cleanup costs, environmental liabilities, or third-party claims arising from improper waste or slurry handling, storage, or disposal.

Any additional disposal or cleanup costs caused by the Client’s failure to provide adequate receptacles or comply with these requirements will be billed to the Client at the Contractor’s standard rates plus a reasonable service fee.

This provision survives the completion or termination of the contract.

Paint and Wall Coverings

Tampa Terrazzo works as close as possible to walls and baseboards and applies tape and plastic 24 inches up from the floor. The Customer will be responsible for touching up painted or wallpapered surfaces. Tampa Terrazzo may touch up baseboards if the Customer has the exact paint for a nominal charge.

Materials and Equipment

Supplies, materials, and equipment remain the property of Tampa Terrazzo. The Customer is responsible for any loss and for prevention of vandalism.

Work by Others

Tampa Terrazzo is not responsible for any work performed by other contractors. This includes defects in the concrete slab, cracks, spalling, or water damage caused by salt intrusion or hydrostatic pressure. The Customer warrants that the concrete slab is free of defects before Tampa Terrazzo begins its work.

Customer-Furnished Materials

Tampa Terrazzo is not responsible for materials or labor the Customer supplies. Use of the Customer's own materials or equipment is at the Customer's own risk.

Unexpected Conditions

Tampa Terrazzo is not responsible if actual site conditions differ significantly from what is normally expected.

Price Changes

Quoted prices are based on current costs. Prices may change without notice if labor or material costs increase before work is completed.

Customer Protections

Tampa Terrazzo stands behind the quality of its workmanship. Any defects in materials or installation will be addressed in accordance with the manufacturer's warranty or Tampa Terrazzo's standard one-year workmanship warranty (whichever applies). The Customer must notify Tampa Terrazzo in writing within 30 days of discovering any issue.

Warranty

Tampa Terrazzo makes no warranties (express or implied). Any product warranty comes only from the manufacturer. Any unpaid balance will void the manufacturer's warranty.

Access to Work Area

The Customer agrees to provide Tampa Terrazzo and its team full access to the work areas and storage space. The Customer will not hire Tampa Terrazzo employees or subcontractors for other jobs.

Jobsite Access and Safety

The Client acknowledges that the jobsite is an active work area containing potential hazards, including but not limited to uneven surfaces, tools, equipment, materials, dust, noise, open excavations, heavy machinery, wet or slippery floors, electrical cords, and other construction-related dangers. AL Services of Tampa Bay, LLC (the “Contractor”) will take reasonable precautions to secure the work area during active operations, but the Client and any third parties (including family members, visitors, tenants, or others) are strictly prohibited from entering the jobsite without the express prior approval of the Contractor’s authorized representative.

The Client agrees to: • Keep themselves, their family, pets, tenants, guests, and any other persons away from the jobsite until the Contractor has notified them in writing that the work is fully completed and the area is safe for re-entry. • Not interfere with ongoing work, remove barriers, signage, or safety equipment, or enter the premises before, during, or after work hours without permission. • Notify the Contractor immediately of any unauthorized access or safety concerns.

Liability Disclaimer

THE CLIENT EXPRESSLY ASSUMES ALL RISKS associated with entering the jobsite at any time, including before the work begins, during operations, or after the Contractor has left the site but before final completion and acceptance. The Client, on behalf of themselves and all other persons entering the jobsite with their permission or knowledge, voluntarily releases, waives, and discharges the Contractor, its owners, employees, agents, subcontractors, and insurers from any and all claims, liabilities, damages, injuries, losses, or causes of action (including but not limited to bodily injury, death, or property damage) arising out of or related to entry onto the jobsite, regardless of whether caused by the negligence of the Contractor or otherwise. This release extends to all such claims whether known or unknown at the time of signing.

The Contractor shall not be liable for any injury, damage, or loss suffered by the Client or any third party due to unauthorized or premature entry onto the jobsite. The Client agrees to indemnify, defend, and hold harmless the Contractor from any claims, demands, or lawsuits brought by third parties resulting from such entry.

This provision survives the completion or termination of the contract.

Assignment

This contract cannot be transferred to another party without written consent from both sides.

Governing Law

This contract is governed by the laws of the State of Florida. Any legal disputes must be handled in Hillsborough County, Florida.

Notice and Right to Cure

If the Customer has a complaint, the Customer must send Tampa Terrazzo a detailed written notice by certified mail. Tampa Terrazzo will have 30 days to address the issue.

Time Limit for Claims

Any legal action must be started within 2 years after the job is completed.

Entire Agreement

This document is the complete agreement between the parties. No verbal promises apply. If any part of this contract is ruled invalid under Florida law, the remaining parts stay in effect.

Dispute Resolution and Acknowledgment of Terms

Acknowledgment and Acceptance of Terms By agreeing to have work performed by AL Services of Tampa Bay, LLC (dba Tampa Terrazzo), the Customer is responsible for searching for and reviewing the Terms and Conditions on our website (tampaterrazzo.com) or requesting a copy of the Terms and Conditions prior to or at the time of agreeing to the work. The Customer acknowledges that they have read, understood, and accepted these Terms and Conditions in their entirety. The Customer further acknowledges that the full Terms and Conditions may not be printed or visible on estimates or invoices. Failure to search for, request, or read these Terms does not relieve the Customer of their obligations or waive any provisions herein.

Mediation Requirement The Customer hereby agrees that any disputes arising under these Terms and Conditions, the related estimate, invoice, or any agreement with AL Services of Tampa Bay, LLC shall be subject to non-binding mediation in Hillsborough County, Florida, prior to the escalation of any legal proceedings, arbitration, or litigation. Mediation shall be conducted through a mutually agreed-upon mediator or a court-appointed mediator in accordance with Florida law. Each party shall bear their own costs for mediation unless otherwise agreed.

Important Notice:

By accepting services or making any payment, the Customer confirms that they have read, understood, and agree to these Terms and Conditions. They form a binding part of the contract with Tampa Terrazzo By Al Services Of Tampa Bay LLC.
